Course Aims:
An advanced course for practitioners and those that assess mental capacity. The course will reinforce the 5 principles of the MCA and how to apply them in significant and complex situations.
Course Outcomes;
- Know about the 5 principles of the MCA and how to apply them in significant and complex situations. Principle 2 and Case Law to support. Consent to Treatment, Valid Consent, supported decision-making and legal authority if no consent.
- Section 5 and 6 of the MCA and their importance. Consider restrictions/restraints within the MCA when it is appropriate & lawful, Explain the limits on power and control in health / care setting. Distinction between restraining a person & taking away a person's liberty. Care Planning and lawful restrictions.
