Aim:
This training will provide a comprehensive overview of the legal framework for Section 117 aftercare funding.
Learning Outcomes:
The training will include the following:
- An overview of Section 117 aftercare as a joint, freestanding duty
- The new legal framework for establishing health responsibility for Section 117 aftercare, including how to apply the NHS Responsibilities Regulations 2022 and the updated 2022 Who Pays guidance
- The legal framework for establishing social care responsibility for section 117 aftercare, including the impact of the Court of Appeal decision in Worcestershire - in relation to Wales
- The concept of ordinary residence and guidance on how to identify where a person is ordinarily resident
- How to approach and work through a potential commissioning dispute including an overview of the local authority dispute regulations and the Who Pays arbitration process and
- Case studies to help attendees understand how to apply the legal framework in practice
