Planning and Public Protection Privacy Statement

Background:

This privacy notice explains how the Planning and Public Protection department of Powys County Council use's your personal information in the course of our work.

 

What We Collect:

In order to deliver the Planning and Public Protection Service it is necessary for the council to process your information. We may collect, for example, the following information:

  • Name and address
  • Contact information including email address and telephone number

Other personal information you might submit as evidence, such as information about health conditions, within for example:

  • A planning or listed building application;
  • Planning Policy related representations;
  • An application for building regulations, notice of demolition, unauthorised works, dangerous structures, retaining walls or safety at sports grounds;
  • An application for a licence with the Environmental Health or Trading Standards service including (but not limited to) Taxi licensing, Licensing Act, Special procedures, Petroleum and the Registration of food businesses.
  • Other personal information to meet health & safety / suitability / grant monitoring requirements for participation in activities (i.e. to establish activity readiness).
  • Civil Contingencies planning/emergency response;
  • Vulnerability mapping including Unique Property Reference Numbers drawn from sources including Welsh Government and Powys County Council Social Care records;
  • Community Safety duties and activities.

 

What we do with the information we gather:

Powys County Council is the data controller for the personal information you provide. Your information will be used in the exercise of our official authority pursuant and as prescribed by statute.  It will not be used for any other purpose, unless it is considered compatible, and within our legitimate interests do so. We will not share your data with third parties unless we are required or permitted to do so by law.

We may process your personal information collected for the following reasons:

  • As part of the statutory records we hold under Primary legislation identified at Appendix 1, along with all other subordinate secondary legislation and Regulations.
  • As part of the provision of our Planning Pre-Application Advice Service.
  • To assess suitability and fitness to be issued with a taxi or private hire licence and to assist us in managing the licence.
  • As part of our Enforcement Investigations under the above-referenced Acts and Regulations.
  • As part of our provision of our Pre-purchase and Completion Certificates services.
  • Building Control Added Value Services.
  • As part of 'Distribution Lists' targeted at providing you with information about:
    • Planning
    • Building Control
    • Environmental Health
    • Civil Contingencies
    • Community Safety
    • Trading Standards Applications
    • Policies and Procedures, including relevant National information and/or guidance.
  • To contact you for research purposes to enable us to improve the services we offer. We may contact you by email, phone, or mail. However, should you inform us that you do not wish to be involved then your records will be noted accordingly.

Any personal data processed by us is done in accordance with data protection legislation.

We will retain this information in accordance with our statutory requirements.

Information received from Welsh Government for the purpose of emergency response is deleted once the information is no longer required.

We will only disclose your personal data when obliged to by law or where it is lawful to do so, such as on occasion to the following:

  • Internally with other Powys County Council Departments.
  • Organisations/ Regulatory Authorities who assist us in delivery of our Services.
  • Your legal representatives.
  • Partner authorities through the Local Authority Building Control Partner Authority Scheme in relation to Building Regulation applications.
  • To keep a public register in relation to the licences / registrations which we have issued.

Security:

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. 

If you are submitting information which you would like to be treated confidentially or wish to be specifically withheld, please let the Planning and public Protection service know as soon as you can - ideally in advance of submitting the information.

Controlling your Personal Information:

Information held by the Planning and Public Protection Service will be retained in accordance with the legislation and the Councils' retention schedule. 

Please see our retention schedule which explains how long we keep personal information for. DBS certificates will be retained for no more than 6 months.
