Mental Capacity Advanced Full Day Virtual training 09.15 hrs for registration. Study day 09.30 hrs to 16.30hrs
Know about the 5 principles of the MCA and how to apply them-Principles of the MCA & how to apply them in significant and complex situations. Assisting a person to make their own decisions-Principle 2 and Case Law to support. Consent to Treatment, Valid Consent, supported decision-making and legal authority if no consent.
Best Interests and its importance when managing making decisions for others Acting lawfully in someone's best interest. The importance of involving the person and significant others in the BI decision-making. Case study-P lacks capacity-consider balance sheet approach. Highlight CoP case law demonstrating good practice. Role the IMCA or Advocacy.
Looking at legal protection - section 5 and 6 of the MCA and their importance Consider restrictions/restraints within the MCA when it is appropriate & lawful, Explain the limits on power and control in health / care setting. Distinction between restraining a person & taking away a person's liberty. Care Planning and lawful restrictions.
Court of Protection and its role to explore making decisions in disputes or complex circumstances regarding.
MHA/MCA interface Treatment scenarios including physical, exclusions to treatment for mental disorder, CTO, Anorexia Nervosa, and medical treatment by force. Highlight the practical application of MHA and MCA on treatment situations drawing on relevant case law and from the Codes of Practices of both legislations. Also briefly consider the series of rulings by the Upper Tribunal in relation to the community powers of the MHA and their relationship with DoLS. To clarify the misunderstandings of whether DoLS or the MHA has more rights or is less restrictive.
