Enforcement Policy - Leasehold Reform (Ground Rent) Act 2022
Introduction
Powys County Council ("the Council") has adopted this policy on deciding financial penalties and/or recovery orders under the Leasehold Reform (Ground Rent) Act 2022 ("the Act"), with reference to the considerations prescribed in the Welsh Government's Leasehold Reform (Ground Rent) Act 2022: statutory guidance for enforcement authorities ("the statutory guidance").
The Act uses the terms "landlord" and "tenant" though this policy, as well as the statutory guidance, use the terms "landlord" and "leaseholder" respectively. The statutory guidance states that a leaseholder is a tenant who owns a leasehold interest in property, granted by a person (the landlord) who holds the freehold interest or a superior leasehold interest in that property[1].
This policy applies to any decision made by the Council in its capacity as an "enforcement authority" under section 8 of the Act.
