Rent recovery procedure

This is our procedure for recovering unpaid rent owed by tenants.

Stage 1. We will send you a 1st reminder letter if you miss two weeks' payment.

Stage 2. If you haven't made a payment after one week, we will try to contact you to discuss your arrears.

Stage 3. We will send a final reminder letter if you haven't cleared your arrears or made an arrangement with us to pay.

Stage 4. We will arrange a meeting with you to discuss the reasons for your arrears. At this stage we like to make an agreement with you to repay your arrears.

Stage 5. If you have not taken action to clear your arrears, we will serve you with a Notice of Seeking Possession. If you do not clear or reduce your arrears to the Council's satisfaction within 28 days of the Notice, we will take court action which could result in the loss of your home.

Stage 6. We may contact to you 14 days after serving the Notice of Seeking Possession to remind you of the terms of the Notice and what you need to do to avoid court action.

Stage 7. If we haven't received a satisfactory payment from you after 28 days of serving the Notice of Seeking Possession, we will apply to the county court for a possession order.

Stage 8. Once we know the date of the court hearing we will write to you, urging you to make a satisfactory payment and will arrange to meet with you to discuss the court hearing.

Stage 9. Once your case is heard in court we will write to you to confirm the court's judgement and what you have to do to comply with the court order.

The next stage may involve eviction if the council is granted a Possession order or if you break the terms of a suspended Possession order.
