Rent recovery procedure

This is a brief guide to the Council's usual procedure for chasing unpaid rent owed by current tenants.

Stage 1

1st Reminder Letter is sent to you if you more than 1 weeks' payment.

Stage2          

If no payment is made the Council will try and contact you to discuss your arrears and offer support

Stage 3

2nd Reminder Letter is sent if you have failed to clear your arrears or make a satisfactory agreement to clear the arrears.

Stage 4

We will continue to attempt to contact you by various methods to discuss the reasons for your arrears and any problems you have in paying your rent. At this stage we will look to make an agreement with you to repay your arrears to avoid further action.

Stage 5

If you have not taken action to clear your arrears, the Council will serve you with a Notice of Seeking Possession. If you do not clear your arrears or reduce your arrears to the Council's satisfaction within 1 month of the Notice, we will take court action which could result in the loss of your home.

Stage 6

We will continue to attempt to contact you by various methods to discuss the reasons for your arrears and any problems you have in paying your rent. At this stage we will look to make an agreement with you to repay your arrears to avoid further action.

Stage 7

We will write to you after serving the Notice of Seeking Possession to remind you of the terms of the Notice and what action you need to take to avoid court action.  

Stage 8

If after 1 month of serving the Notice of Seeking Possession we have received no satisfactory payment from you, we may apply to the county court for a possession order.

Stage 9

Once we know the date of the court hearing we will write to you again to urge you to make a satisfactory payment and will arrange to meet with you in order to discuss the court hearing.

Stage 10

Once your case is heard in court we will write to you to confirm the court's judgement (the court will also contact you directly) and what you have to do to comply with the court order.

The next stage may involve eviction if the council is granted a Possession order or if you break the terms of a suspended Possession order.
